National Guardsmen, Reservists, or their employers who experience problems resulting from employee participation in the National guard or reserve, may request assistance from an Ombudsman.
The first attempt to resolve a problem should be made at the employer-employee level. Often, a calm, objective discussion can reveal solutions if conducted in an atmosphere of mutual cooperation.
If that fails, unit commanders should be consulted. Commanders have a vested interest in the problem and may be able to explain the situation or suggest compromises that will satisfy everyone's needs.
Services:
The ombudsman provides advice about rights and responsibilities under the law and seeks a solution through mediation that can provide quick problem resolution. This service is informal; discussions are not entered into personnel records. The objective is to eliminate misunderstanding and reslove difficulties to the satisfaction of all concerned.
South Carolina ESGR ombudsmen handle only employer-employee conflicts involving military service. Cases that require legal advice or assistance are referred to the United States Department of Labor.
